1: GENERAL
For the purposes of these terms, the 'Company' will refer to RUA Productions. The 'Customer' will refer to an individual or external company renting from the Company. The 'Equipment' or 'Goods' will encompass all items hired to the Customer by the Company.
2: NEW CUSTOMERS
All new customers must present relevant identification when collecting the Equipment. This should include a passport or driver's license, as well as a current utility bill that verifies their name and address.
3: CARE OF GOODS
The Customer agrees to handle the hired Goods with care and not to tamper with their working mechanisms or any other parts. They will exercise reasonable care, using the Goods for their intended purpose in a lawful, safe, and correct manner, following any provided operating and safety instructions. Furthermore, the Customer will promptly notify the Company in case of any breakdown, loss, or damage.
The Customer must take adequate measures to safeguard the hired Goods against theft, damage, or other risks. They should inform the Company of any changes to their address and, upon request, provide details of the locations where the Hire Goods are located, allowing the Company to inspect them at reasonable times, including accessing the property where the Hire Goods are situated.
The Customer agrees to keep the Hire Goods under their possession and control at all times, without removing them from Ireland unless prior written consent is obtained from the Company. The Customer will bear the responsibility and costs associated with any required testing, examinations, or checks concerning the Hire Goods, as mandated by legislation, best practices, or operating instructions, unless otherwise provided by the Company as part of any Services.
The Customer will not undertake any actions or omissions that may invalidate any insurance policy related to the Goods. In case the Goods are damaged, the Customer agrees not to continue using them and will promptly notify the Company of any incidents resulting in damage, loss, or injury to any person or property.
The Customer agrees to return the Goods to the Company in good working order and condition, with reasonable wear and tear accepted. Additionally, the Goods should be returned in a clean condition, except for everyday grime, and accompanied by all relevant insurance policies, licenses, registrations, and other related documents.
4: PAYMENT
All rentals must be fully paid at the time of collection. Certain Goods may require a security deposit, which will be refunded at the end of the rental period. If the Customer returns the Goods in damaged or unacceptable condition, the Company reserves the right to retain the deposit (or a portion thereof) as compensation for any loss or damage incurred.
Unless otherwise agreed, all Goods must be returned by 12 noon on the designated return date. Late returns may incur additional hire charges.
5: DELIVERY, COLLECTION, AND SERVICES
The Customer is responsible for collecting the hired goods from the Company. However, the Company may offer delivery services for a fee. The Customer bears responsibility for the acts or omissions of their agents, employees, subcontractors, or any other person acting on their behalf under this agreement. Similarly, the Customer is responsible for the acts or omissions of the Company's staff and agents when they act under the Customer's direction, instructions, guidance, or advice.
The Customer must ensure sufficient access to and from the relevant site, as well as provide unloading space, facilities, equipment, and access to power supplies for the Company's employees, subcontractors, or agents to perform the Services. The Customer warrants that the site where the Services are to be carried out is safe, cleared, and prepared before the scheduled commencement of the Services.
If any Services are delayed, postponed, or canceled due to the Customer's failure to fulfill their obligations, the Customer will be liable to pay the Company additional charges, as per the standard rates, for such delays, postponements, or cancellations.
6: LOSS AND DAMAGE
In addition to insurance coverage, the Customer assumes responsibility for any loss or damage to the Equipment that occurs after collection or delivery and before the Equipment is returned to the Company. In the event of theft, the Customer agrees to immediately report the loss to the Company and file a report with An Garda Síochána. If the Equipment is lost, stolen, missing, destroyed, or not returned for any reason, the Customer will be liable for the cost of replacing the item with a comparably equipped model at the current retail price, minus any available discounts, without accounting for depreciation. In case of damage or breakage or incomplete return of the Equipment, the Company will assess the extent of the damage and necessary repairs. The Customer (or their representative(s)) will have a reasonable amount of time to inspect the damage. The Company's judgment regarding whether the Equipment should be replaced or repaired will be conclusive. The Customer will also be responsible for any loss or damage suffered by the Company, including the daily rental value of the Equipment from the pickup date until it is returned, repaired, or replaced during the rental term.
7: INSURANCE
The Customer agrees to insure the Equipment with a suitable insurance carrier, covering its full value. The Company must be named as an additional insured and loss payee on the Customer's liability and equipment policies. Upon demand by the Company or at the time of equipment hire, the Customer will provide a Certificate of Insurance. The insurance coverage should include loss or damage, whether in Ireland or abroad, during transit or otherwise. If the Customer intends to use the equipment outside of Ireland, they must notify the Company and obtain permission. For rentals outside Ireland, the Customer is responsible for prepaying any customs duties, excise taxes, brokerage charges, shipping fees, taxes, or other charges that may be imposed by any country.
